Firm director, wife and daughter move Punjab and Haryana HC against FIR filed by son-in-law

Advocate Abhinay Goel, counsel for petitioners, contended earlier than HC that the wedding between the complainant husband, Amit Goel, and spouse (daughter of Purushottam Beriwala) had been solemnized in December 12, 2014 at Kolkata. Thereafter daughter of Beriwala shifted from her parental home located in Kolkata to her matrimonial home located in Panchkula and began residing as husband and spouse with the complainant. Following altercations together with her husband, Beriwala’s daughter, returned again to her parental home at Kolkata from Panchkula, and gave a criticism towards her husband, Amit Goel and her in-laws, for alleged harassment, to Kolkata Police.

Advocate Goel, contended that Amit Goel, with a purpose to save him and his members of the family from the case at Kolkata, gave a counterblast criticism to the police at Panchkula to create strain upon his spouse and her household in order that they might withdraw all their complaints. Thus the FIR dated November 11, 2019 underneath sections of rioting, housebreaking, and trespassing registered at PS Sector 5 Panchkula has been registered by Amit Goel as a counter to the FIR registered on January 7, 2019 underneath Sections 498 A (Husband or relative of husband of a lady subjecting her to cruelty) and 406 (felony breach of belief) of IPC registered at Police Station Bidhan Nagar East, Kolkata made by his spouse.

The petitioners have pleaded on the HC for staying the proceedings at trial courtroom until the ultimate order of the current case at HC.
